Terms of Service

1. Agreement to Terms

By accessing or using ClothStudio.AI's virtual try-on platform and related services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and ClothStudio.AI, Inc. ("ClothStudio.AI," "we," "us," or "our").

2. Modifications to Terms

We reserve the right to modify these Terms at any time. If we make changes, we will provide notice by updating the date at the top of these Terms and by maintaining a current version of the Terms at clothstudio.ai/terms. Your continued use of the Service after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these Terms or any future Terms, do not use or access (or continue to access) the Service.

3. Eligibility

You must be at least 13 years of age to use the Service. By agreeing to these Terms, you represent and warrant that: (i) you are at least 13 years of age; (ii) you have not previously been suspended or removed from the Service; and (iii) your registration and your use of the Service is in compliance with all applicable laws and regulations. If you are under 18, you represent that you have your parent or guardian's permission to use the Service and that they have read and agree to these Terms.

4. Privacy

Please refer to our Privacy Policy at clothstudio.ai/privacy for information about how we collect, use, and disclose information about you. By using the Service, you consent to our collection, use, and disclosure of information as described in our Privacy Policy.

5. Subscriptions and Payment

5.1. Subscription Plans. Some features of the Service may require a subscription. By subscribing to the Service, you agree to pay the subscription fees indicated for your selected plan. Subscription fees are non-refundable except as required by law or as explicitly stated in these Terms.

5.2. Billing. We use a third-party payment processor to bill you. The processing of payments will be subject to the terms, conditions, and privacy policies of the payment processor. We are not responsible for any errors by the payment processor.

5.3. Auto-Renewal. Unless you cancel your subscription before the end of the current billing period, your subscription will automatically renew, and you authorize us to charge your payment method for the next billing period.

5.4. Cancellation. You may cancel your subscription at any time by accessing your account settings or contacting us at support@clothstudio.ai. Upon cancellation, your subscription will remain active until the end of your current billing period, but will not be renewed thereafter.

6. User Content

6.1. Definition. "User Content" means any content that you upload, submit, or otherwise make available to the Service, including photographs, model images, clothing images, and other visual or textual content.

6.2. Ownership. You retain ownership of any intellectual property rights you hold in your User Content. By uploading User Content, you grant ClothStudio.AI a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, create derivative works from, distribute, perform, and display your User Content in connection with operating and providing the Service.

6.3. Restrictions. You agree not to upload User Content that:

• Violates any third-party rights, including intellectual property rights
• Is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Contains sexually explicit material, pornography, or nudity not relevant to the virtual try-on service
• Promotes discrimination, racism, hatred, or violence against any individual or group
• Contains harmful software or code designed to interrupt, destroy, or limit the functionality of any software or hardware

6.4. Removal. We reserve the right to remove any User Content that violates these Terms or that we determine in our sole discretion is harmful, offensive, or otherwise inappropriate.

7. Intellectual Property

7.1. ClothStudio.AI Property. The Service and its original content, features, and functionality are owned by ClothStudio.AI and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any materials from the Service, except as generally and ordinarily permitted through the Service according to these Terms.

7.2. Feedback. If you provide us with any feedback or suggestions regarding the Service ("Feedback"), you hereby assign to us all rights in such Feedback and agree that we shall have the right to use and fully exploit such Feedback in any manner we deem appropriate.

8. Termination

8.1. By ClothStudio.AI. We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

8.2. By You. You may terminate your account at any time by following the instructions on the Service or by contacting us at support@clothstudio.ai. Upon termination, your data may be permanently deleted from our servers and we may not be able to recover it. If you have a paid subscription, you will continue to have access to the Service until the end of your current billing period.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. CLOTHSTUDIO.AI AND ITS AFFILIATES, SUPPLIERS, AND LICENSORS DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. CLOTHSTUDIO.AI DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED. CLOTHSTUDIO.AI DOES NOT MAKE ANY WARRANTY REGARDING THE QUALITY, ACCURACY, TIMELINESS, TRUTHFULNESS, COMPLETENESS, OR RELIABILITY OF ANY CONTENT AVAILABLE THROUGH THE SERVICE.

10. Limitation of Liability

IN NO EVENT SHALL CLOTHSTUDIO.AI, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; AND (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States of America and the state of New York, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
